1. Parties
These Terms govern the CMART-Starter Leads Engine Trial subscription between Creative Media Agency (Pty) Ltd, a sub-division of Digital Business Solutions Holdings (Pty) Ltd (acting as SaaS Agency for The CMART™-App), and the Client who activates the trial or subscription.
2. Free Trial Terms
Important: The 14-day free trial begins on the date of signup. Cancel before day 14 and no charge will be made. After day 14, billing commences automatically at R1 000/pm.
- The 14-day free trial provides full access to all CMART-Starter Leads Engine features at no cost.
- The trial period begins on the date the Client activates the subscription — not on the date the website goes live.
- To cancel the trial without charge, the Client must notify us in writing at [email protected] before 23:59 on day 14.
- If the Client does not cancel before day 14, the subscription will automatically convert to a paid plan at R1 000 per month (incl. VAT) and billing will commence.
- Only one free trial is permitted per Client. Repeat trial registrations will not be granted.
3. Subscription and Billing
- Following the trial, the CMART-Starter Leads Engine subscription is billed at R1 000 per month (incl. VAT) on a recurring monthly basis.
- Billing is processed automatically via the CMART™-App payment system on the same date each month.
- Failure to pay may result in immediate suspension of all CMART-Starter Leads Engine features, including CRM access, automation workflows, and lead pipelines.
4. What's Included
- CRM pipeline and contact management
- Automated lead follow-up sequences (email + WhatsApp)
- Online appointment booking calendar
- Monthly performance reporting
- Integration with the Client's SMART Website lead capture forms
- CMART™-App client dashboard access
5. Cancellation Policy
- The Client may cancel the CMART-Starter Leads Engine subscription at any time by written notice to [email protected].
- Cancellation takes effect at the end of the current billing month.
- No refunds are provided on any payments made. The Client retains access to the platform until the end of the paid period.
- Upon cancellation, all automation workflows will be deactivated and CRM data access will cease.
- The Client may request a data export of their CRM contacts before cancellation takes effect.
6. WhatsApp Automation Compliance
The Client is responsible for ensuring that all WhatsApp automation messages sent via the CMART-Starter Leads Engine platform comply with WhatsApp Business Policy and applicable South African electronic communication laws, including the Electronic Communications and Transactions Act (ECTA). We are not liable for any WhatsApp account suspensions arising from Client misuse of the automation features.
7. Governing Law
These Terms are governed by the laws of the Republic of South Africa, including POPIA and the Consumer Protection Act 68 of 2008.
