When the Client activates the CMART-Starter Leads Engine, the platform collects and processes data relating to the Client's business leads. This includes:
The Client is the Responsible Party for all lead data entered into or captured by the CMART-Starter Leads Engine CRM. Creative Media Agency (Pty) Ltd acts as an Operator processing this data on behalf of the Client.
Automated WhatsApp messages sent to leads via the CMART-Starter Leads Engine are sent on behalf of the Client's business. The Client is responsible for ensuring that recipients have provided appropriate consent to receive communications under POPIA and the Electronic Communications and Transactions Act (ECTA). Creative Media Agency (Pty) Ltd is not liable for non-compliant use of the WhatsApp automation features.
CMART-Starter Leads Engine is built on the GoHighLevel platform. Lead and CRM data may be processed by GoHighLevel Inc. as a sub-processor. Payment data is processed by Stripe Inc. Both sub-processors operate under their own privacy and security policies.
Upon request and prior to account closure, the Client may export all CRM contacts, pipeline data, and communication logs from the CMART™-App dashboard. We will facilitate this export within 5 business days of a written request.
